ENROLLMENT: The Karat & Carat Jewellery Savings Plan (hereinafter “Karat & Carat” or the “Plan”) offered by C. Krishniah Chetty & Co. Private Limited (“C Krishniah Chetty & Co.”/the “Company”) facilitates Customers to purchase C Krishniah Chetty & Co. jewellery by making payments for the same over a ten or eleven month period and the Customers will be entitled to avail certain discounts subject to these Terms and Conditions. Under Karat & Carat, the Customer has 2 options - 10 (Ten) fixed monthly instalments or 11 (Eleven) fixed monthly instalments of a minimum of Rs. 1,000/- (Rupees One Thousand) or above (in multiples of one thousand). Once the instalment duration is selected , it cannot be changed till maturity. For the purpose of this Plan, the date of payment of first instalment shall be deemed as the Enrolment Date Enrolment may be through offline mode, i.e., at the C Krishniah Chetty & Co. stores by duly completing and signing the Enrollment form, along with paying the first instalment. Enrolment is subject to compliance with all other requirements prescribed by C Krishniah Chetty & Co. from time to time. The management of C Krishniah Chetty & Co. reserves the right to accept or reject any enrollment application request without assigning any reason. Merely submitting the prescribed form shall not amount to enrollment. The customers would be eligible for the applicable benefit upon redemption, after the completion of 11 months from the Enrolment Date subject to the Customers having made the payment of all the monthly instalments. Only individuals can enrol into the Plan and enrolment is not permissible for other entities like companies, partnership firms or proprietorship concerns or Trusts or Hindu Undivided Family (HUF) or NRI Customers. Minors may enrol only through their natural guardians. The customer is required to provide a copy of his/her photo identity and address proof documents like Driving Licence/Voter ID/ Passport /Ration Card/PAN Card/any other document issued by the Government, bank account details, etc. at the time of enrolment. In case of any change in contact or address details or any other details that the customer may have furnished, the customer shall immediately contact customer care for effecting the changes with supporting documents . All communication by C Krishniah Chetty & Co. shall be addressed to the address/email id furnished by the customer in the form. Communication sent to such an address shall be deemed to be adequate discharge of C Krishniah Chetty & Co.’s responsibility. The Customer should especially ensure that the name is as per the identity proof provided by the Customer, and not in any other name, including nickname or short forms. C Krishniah Chetty & Co. reserves the right to verify the identity of the customer by means of SMS and/or OTP generation or by any other means at any time including at the time of enrolment and at the time of concluding the purchase and taking the delivery of the jewellery. C Krishniah Chetty & Co. also reserves the right to verify the authenticity of the documents provided by the Customer. At the time of enrolment, the Customer should ensure that the Karat & Carat Enrolment Form is signed in the space provided, accepting these terms and conditions and handed over to our Relationship Manager. After completing the enrolment process, the customer will be provided with a Karat & Carat Savings Plan card. MONTHLY INSTALLMENT: During the course of the Plan, the customer has to pay one instalment every month. More than one instalment will not be allowed. Delayed or missed instalments will result in benefits not accruing for that particular month. Customers will have to make the payment of the instalment on the Due Date. For the purpose of this Plan, the Due Date shall be the same date as the Enrolment Date for the subsequent months. However, the customer shall be provided with a grace period of 7 (Seven) days in a month for payment of the instalment. In the event the Customer fails to pay the instalment within the grace period, the customer will not be eligible for any benefit or bonus for that month. C Krishniah Chetty & Co. will not be responsible for any delay on account of postal, courier or bank services. Payment of monthly instalment(s) may be made by cash, credit / debit cards, NEFT/ RTGS, online payment link (if available) ,Standing Instruction, local cheques in favour of “C. Krishniah Chetty & Co. Private Limited” payable in the city where the store, in which the account was opened, is located . International cards for online payment will not be accepted. In case of cheque dishonour, the bank charges shall be borne by the customers. C Krishniah Chetty & Co. shall not be responsible for any online payment failure and money being debited from the customer’s account. Customers are requested to check with their banks or other service providers for such payment failures. It is the responsibility of the account holder to enter details correctly. Receipt for payment made by Standing Instruction (“SI”) will be made only after money has reached our account. In case of SI enabled accounts, the Plan cannot be closed prior to maturity date unless the account holder has cancelled the SI by submitting the required forms to C Krishniah Chetty & Co. The customer may ask for a computerised receipt, from the C Krishniah Chetty & Co. store. Post Dated Cheques in advance favouring C.Krishniah Chetty & Co. Private Limited , duly crossed and marked ‘account payee only’. If any cheque/ demand draft submitted towards the instalment is dishonoured, Rs. 200/- will be charged to the customer. Receipts will be issued towards the instalment amount credited to the savings scheme account. The Company or the C Krishniah Chetty & Co. stores will not be responsible or liable to send reminders for payments. Payment towards any preceding instalment needs to be realised before crediting payment towards succeeding instalments. Both the 10 + 1 month Plan and the 11 month Plan will mature after 11 months from the Enrolment Date and the Customers will be eligible to redeem by purchase of jewellery from the Company at C Krishniah Chetty & Co. stores. The customer is mandatorily required to redeem his/her account before the completion of 365 days from the Enrolment Date. The accounts opened under this Plan are redeemable at C Krishniah Chetty & Co store only. It cannot be redeemed at CKC & Sons, CKC & Jewellers Pvt. Ltd. REDEMPTION: 1 At the time of purchase of jewellery, the account holder has to personally come and produce a valid photo identity proof and PAN Card, along with the Savings Plan card and effect the redemption of the instalments paid towards purchase of jewellery. The Company reserves the right to satisfy the identity of the Customer in any manner it deems fit. 2 Benefits of the Plan are available only to the extent of the accumulated amount/weight in the customer’s account. For the balance quantity/amount on the chosen article, the charges applicable at the time of redemption are payable. 3 Metal and diamond rate booked or charged on the invoice shall be based on the Company’s prevailing rate during payment of instalment and/or on the date of jewellery purchase 4 In addition to the gold and stone charges, all jewellery purchased under the Karat & Carat Jewellery Savings Plan will be subject to making charges, wastage charges, material charges, Goods and Services Tax, or any other surcharges, levies as may be applicable/ prevailing at the time of purchase. 5 Instalment amounts paid can be utilised only to purchase Gold, Diamond & Platinum jewellery and Silver articles at our showroom. Gold, Silver and Platinum coins or bars cannot be purchased under this Plan. 6 The Customer will have to purchase the jewellery for the total instalment amount paid and partial purchase is not allowed. 7 The plan can be adjusted towards new customer orders if it covers the minimum advance of 35% of the total value and the ordered product will be delivered once the savings plan has matured. 8 Customers should handover the original Savings Plan card, ALL receipt vouchers and provide proof of identity as may be prescribed by C Krishniah Chetty & Co. to redeem the Plan. 9 Premature withdrawal before maturity will not avail any benefits. Only the principal amount accumulated till date will be considered for jewellery purchase.10 A cash refund or return of instalments paid shall not be made under any circumstances. 11The plan cannot be clubbed with any other schemes or offers.12 Maturity date of the Plan cannot be revised during the tenure of the scheme. Delayed payments cannot extend the maturity date either.13 The Plan is not transferable or assignable in any manner to other individuals.14 Multiple accounts of a customer can be clubbed to purchase a single item, provided the customer has opted for the same variant of the saving schemes for clubbing. 15 If the customer loses the Plan card, it should be reported to C Krishniah Chetty & Co. immediately and obtain a duplicate card after paying the applicable charges and executing such indemnity as C Krishniah Chetty & Co. may require. OTHER: 1 The Customer may appoint a nominee at the time of enrolment upon submission of relevant documentation. In the event of death of the account holder, the amount is transferable by the Company only to the person(s) whose nomination has been filled by the account holder in the Enrolment Form at the time of opening the account subject to such nominee producing identity and address proof. In case the account holder does not nominate any person, any claim(s) made by any other person(s) on behalf of the account holder will not be entertained unless such person being a legal heir/duly authorised person claiming the benefits under the Plan, shall produce below documents to the Company: i Death certificate of the deceased.ii Succession Certificate.iii NOC from other surviving legal heir for redemption.iv Indemnity undertaking to indemnify C Krishniah Chetty & Co from claims. v Will (if any) vi Along with all other supporting documents and clarifications vii However, the decision of the Company shall be final on sufficiency of any document in all such cases above and the same shall be binding upon the claimants. 2 The Company reserves the right to alter, amend, add or delete part or whole of the privileges of the Plan without prior notice to the account holder, as long as the same is not detrimental to the interests of the account holder. 3 The Company is the operator of this Plan and reserves the right to suspend the Plan at any time. In any such event, the account holder may purchase any item at the C Krishniah Chetty & Co. store equal to the value of the instalments accumulated in his/her Karat & Carat account along with benefits accumulated, as on that day. 4 The liability of the Company under the Karat & Carat Jewellery Savings Plan is limited to the extent of instalments/advances paid by the account holder(s) and the benefit, as per the Plan and the terms and conditions contained herein, and thus does not lead to any other assurance or warranty whatsoever by the Company. 5 Any conditions that are not explicitly covered above would be the discretion of the Company at the time of transaction/redemption. The decision of the Company in this regard would be deemed as irrevocable and final. 6 Disputes if any will be subject to the Courts in Bangalore jurisdiction only, to the exclusion of any other court's jurisdiction. 7 In case of any change in existing laws, rules, Acts, etc. by any regulatory authority, the Company reserves the right to make such modifications/change/suspend/discontinue the Plan suitable to the change of law and necessary requirements as per the same have to be complied with by the account holder.
